An action was brought recently, against Mr. Simpson, manager of the Park Theatre, New-York, for harboring and employing two apprentices as supernumeraries, on the stage. There was no proof that he knew the boys to be apprentices, upon which ground a non-suit was demanded. The court in sustaining the motion for a non-suit, took occasion to comment with much severity on the custom of employing boys as supernumeraries, and to mark their detestation of the practice. His honor the judge then directed a non suit to be entered, subject to a case to be made, and if, on more reflection, he should deem it proper, to restore the parties to their rights.
