On Thursday last, being the first day of the Madison Circuit Court came on for trial, the case of the State of Indiana versus James Hudson, for murdering LOGAN, one of several Indians, supposed to have been murdered by Harper, Sawyer and son, and Bridges and son, on the 22d of March last, at Fall Creek.
As the murder of these Indians has excited unusual interest, we give the following brief sketch of the trial without comment.
The court, after consuming the greater part of the day, continued in session until a late hour in the night, when a jury being selected and placed under the care of bailiff, adjourned until Friday morning, six o'clock, and proceeded further in the trial. Jones, a young man about seventeen or eighteen years of age, was the only witness produced on the part of the state who was examined. The examination witnesses and the arguments of counsel (which were restricted) lasted till 1 o'clock P. M. at which time the jury retired, after a short but comprehensive charge from the presiding Judge, and after being out about an hour, returned with a verdict that the defendant was GUILTY of murder, charged in the indictment.
The court then proceeded in the case of the State versus the younger Bridges, who was indicted as a principal aider and abettor with Hudson, in the murder of Logan the Indian Chief, and continued in session until late hour in the night, and adjourned.
Tuesday morning, at which time, bailiffs sent out to summon men to sit as jurors, not having returned, James Hudson was brought into court to hear his sentence, at which his counsel offered reasons for a arrest of judgment, which were argued and over-ruled. The court then, in a very solemn and impressive manner, passed judgment on the defendant.
Considering the vast crowd who had assembled to witness a trial so very interesting to the community, the greatest order and decorum prevailed, during the whole session. Messrs. Gregg, Noble and Sweetser, were counsel for the state, and Messrs. B. F. Morris, Fletcher, Wm. R. Morris and Martin M. Ray, for the defendant.
Hudson is to be executed between the hours of ten and two, on Wednesday the 1st of December next.
John T. Bridges and his son John Bridges and Stephen Sawyer are still in confinement. Their trial will be decided at the next term, as it is supposed some provision will be made at the next session of the legislature for a more speedy trial.
