Abe Chasanow, attorney for the Greenbelt Rent Protest Committee, announced the receipt of a letter last Thursday notifying him that the Public Housing Administration attorney, in his answer to the show cause order filed by the Rent Protest Committee, has filed a motion for summary judgment. (A summary judgment is a decision based on a point of law, rather than the facts at issue.) It is the contention of the PHA attorney that the government is not subject to rent control, and he is basing his whole case on the Supreme Court's decision in the Wittek case (June 1949) that the Rent Control Act did not apply to housing owned or operated by the U. S. government.
Mr. Chasanow stated that it is his interpretation that the regulations of the Office of the Housing Expediter apply the provision of the Rent Control Act to the U. S. government and its agencies as well as to private landlords.
The case is due to come up for a hearing in Federal Court in Baltimore soon.
