DAN'S DEATH.
The Brave Young Deputy Sheriff Succumbs to His Accidental Injuries.

Warm friends of Mr. Dan McClusky began to hope yesterday morning that his injuries received in his accidental shooting at the Revolving Light saloon last Thursday would not, after all, prove fatal, as a change for the better was noticeable at that time. Yesterday afternoon, however, he sank so rapidly that death occurred at 6 o'clock. He made no other statement than that given to Justice Chas. Barnes Saturday morning, and was unconscious at the time of his death. The remains were interred this afternoon from St. Mary's church, at 1 o'clock, and the funeral was attended by a large number of the city and county officials, and friends and relatives of the deceased. The innocent cause of his death, Constable Stevens, was placed in the county jail last night on the death of McClusky, more as a matter of compliance with the law than for anything else. This morning at 9 o'clock, the preliminary examination of Constable Stevens on the charge of assault with intent to kill, was convened before Justice McAllister. After a long and exhaustive examination of witnesses Ball, Fitzhenry, Kroeger, Barnes, and Drs. Hays, Herff, Braunnagel and Bennett, in which there was not a bit of evidence to show that the shooting was intentional, the court held the prisoner in the nominal bond of $500, which he readily gave. His previous bond was $5000, which is quite a reduction, as negligent homicide is the only charge upon which the state can hold Mr. Stevens. His friends have no fear of the result of the grand jury's investigation, or the final disposition by the district court. Negligent homicide will not stick, either, if any credit can be given the dying statement of the deceased.
