Despite Alabama authorities refusing to honor a Wayne County kidnapping warrant for a Birmingham bondsman in the transfer of Gerdis Hill from Detroit to that city, Prosecutor Gerald O'Brien said Tuesday that he will push compliance of extradition proceedings.
The warrant, signed by Recorder's Judge W. McKay Skillman last Monday, names Herbert G. Batson, the bondsman, and a John Doe, an assistant, as forcibly transporting Hill to Birmingham on Dec. 27.
E. H. Brown, Birmingham Chief of Police, stated that the Jefferson County Ala court would not issue a fugitive warrant for Batson because Detroit Chief of Detectives Jack Harvill had only sent a certified copy of the kidnapping warrant. He said the original of the warrant is required.
Silly Request
Prosecutor O'Brien termed the request as silly since the Alabama extradition law is the same as Michigan's, adding that it was one of 30 states having an agreement to accept certified copies of warrants.
O'Brien said that he had a copy from Jefferson County right at that moment which was sent in another case. He stated that it was honored and a fugitive warrant was obtained for them.
The certified copy of the warrant would be sent right back to the Chief of Police with insistence that it be carried out. O'Brien revealed.

Hill now serving a 30-day sentence in Birmingham, was held on charge of driving without a license when he jumped a $300 bond and fled to Detroit. Early Ruling Judge G C. Boner of the Birmingham Inferior Court ruled last Thursday that there was sufficient evidence against Batson.
