In Cape Francois, captains Loring and Backus' vessels were seized by a French king's brig 30 leagues offshore for carrying coffee and sugar, suspected from the island. Condemned by admiralty despite evidence of purchase elsewhere, they appealed to the superior council amid local outrage over the trade abuse and threats of flogging.

Extract of a letter from a gentleman at Cape Francois, to his friend in this place, dated Jan. 28.
"Capts. Loring and Backus are here, seized for having coffee and sugar,--they were taken, overhauled, and those articles found on board, by a King's brig, 30 leagues from land, and fetched in here: They are condemned by the admiralty, on the mere suspicion of the sugar and coffee being from this island, though they have proved by their evidence, that one cargo was purchased and taken in at Indague, and the other at sea. They have appealed to the superior council, where their fate will probably be determined in a week:--This is the present matter of conversation here;--every one thinks they cannot, and will not be condemned. It will be hardly safe to send sugar and coffee from New-London to New-York, or elsewhere, if any of his Most Christian Majesty's ships were there. I think it is too gross a national abuse, and if put up with, I do not know what we shall not put up with. The French Capt. threatened to have Capt. Backus brought to the gangway and to give him 40 or 50 lashes."
