Chief Justice Waite, to-day granted a writ of error to the Supreme Court of Appeals of Virginia, in the case of John C. Lindsey, colored, vs. the Commonwealth of Virginia, involving the constitutionality of the statute of that State which prohibits marriages between white and colored persons. Lindsey, the plaintiff in error, came to the District of Columbia about a year ago and married a white woman. Upon his return to Virginia he was arrested and sentenced to the penitentiary, where, pending this appeal he remains. Persons interested in the final settlement of the question of the constitutionality of the State law prohibiting the inter-marriage of the races have brought the case to this court for its decision.
