CHAIRMAN OF DRYS ADMITS DEFEAT BY 5,000 MAJORITY

BUT CLAIMS FRAUDS AND WILL RESORT TO COURTS

Contest Is the Closest in the History of the Lone Star State

Dallas, Tex., July 21—Texas defeated statewide prohibition in Saturday's election, according to the admission today at dry campaign headquarters and also according to returns early today.

After thirty-six hours ballot counting the "wets" maintain a slender lead of hardly more than five thousand in the unofficial returns. Unless the vote yet to come is different in tenor than that up to the present time, the remaining few thousand ballots can not change the election to the drys.

Houston, Tex., July 24—Chairman Ball, of the statewide prohibition committee, today conceded that the anti-prohibitionists have a majority not exceeding five thousand on the face of present returns in Saturday's election. He claims frauds have been practiced and will resort to the courts.

Both sides stand ready to contest the vote. For hours the returns have about divided themselves for and against prohibition. The total vote cast Saturday possibly will exceed 450,000.

The contest is the closest in the history of the state. Tens of thousands of persons collected around bulletin boards watching the returns.

It is practically impossible to forecast what the final returns will show. About 85 per cent of the estimated vote cast is accounted for.

The counties and boxes still missing are widely distributed over the state. Some of them are admittedly prohibition and others certain anti-prohibition. None of them are very large. The reports in hand include practically complete returns from every large city and county.

The total vote cast Saturday probably will reach 475,000. Probably 90 per cent of this is reported. Only a few small counties which lack wire facilities have not been heard from and there are scattered boxes in many other counties still out.

The territory from which the returns are incomplete is about evenly divided between the wet and dry districts.
