Case to Be Heard By District Court
Is An Appeal From Award of
State Board.
Attorneys for the plaintiffs in the
case filed by J. Allen and others vs.
the City of Corpus Christi and others
in the district court, which is an ap-
peal from a decision of the state board
of engineers, granting a certain per-
cent of the flow of the Nueces river to
the city on the ground that the city
has not the riparian rights to be en-
titled to this flow, yesterday filed with
R.O. Cook, district clerk, the
cost bond in the sum of $1000 as pre-
scribed by the clerk last week.
The bond was made up by the Equit-
able Surety Company of St. Louis, Mo.,
of which company Jesse Wright is the
local representative. A certificate to
that effect was issued yesterday. With
this action completed, the case has
now been formally placed on the dock-
et to be heard at the next term of the
district court.
However, there will be one change
in the case, when supplementary pa-
papers will be filed, changing the name,
as C.J. Allen, the present principal has
stated that he does not intend to be-
come a party to the suit, he having
the interests of the city of Corpus
Christi just as much at heart as if he
lived within the city bounds. Mr. Al-
len has publicly announced that he
will not be a party to the suit.
