RULING ON FEPC STATUS AWAITED

Warren Asserts WILL PRESIDE FDR Didn't Mean What Order Says Ross Places Matter In Hands Of Att'y-General WASHINGTON, D. C.-(ANP) Attorney General Francis E. Biddle has been asked for a ruling seeking clarification of the scope and meaning of President Roosevelt's Executive Order 9346 it was announced Saturday by Malcolm Ross, chairman of the President's Committee on Fair Employment Practices, which was created by the order.

The ruling was asked, Mr. Ross said, in view of a ruling by Comptroller General Lindsay Warren, former congressman from North Carolina, flatly denying that President Roosevelt meant what he said in issuing Executive Order 9346, the legal basis for all action by the FEPC.

The President's order directs all government purchasing agents to demand guarantees from firms and their sub-contractors doing business with the government, that they shall not practice discrimination along racial lines.

Handing down a decision in the case of the Southwestern Bell Telephone Company, which refused to give a guarantee, Warren pointed out that the President's order was not an order, and that "shall did not mean must" whenever a contractor threatened to refuse to accept war contracts if the government's guarantee was insisted upon.

Warren contended that compliance with the President's order was a voluntary action and added, "It seems that the most that can be accomplished by government contracting agencies in carrying out the national policy of non-discrimination in the employment of workers as declared by the President is to secure the assent of contractors to such provisions."
