IN SENATE.

The motion submitted yesterday by Mr. Mercer, relative to brevet rank in the army, was taken up and agreed to.

The Senate then resumed the consideration of the bill to amend the charter of the Bank of the United States. Mr. Holmes having withdrawn the amendment offered by him, and pending yesterday when the Senate adjourned--

Mr. Barbour moved to strike out the first section of the bill, together with the proviso added thereto yesterday, making all notes of and under $10 dollars, payable at the Bank or either of its Branches. [This proviso Mr. King of Ala. had got reconsidered, and then made a motion to amend it so as to limit its operation to notes which shall be issued after the passage of this bill, which motion was agreed to.]

After considerable discussion, the question was taken on the motion to strike out the first section, and was determined in the affirmative, as follows:

YEAS--Messrs. Barbour, Benton, Brown of Ohio, Chandler, D'Wolf, Eaton, Holmes of Miss. Knight, Lanman, Lloyd, Macon, Mills, Palmer, Parrott, Pleasants, Rugles, Seymour, Smith, Talbot, Taylor, Thomas, Van Dyck, Williams of Miss.--23.

NAYS--Messrs. Barton, Brown of Lou. Dickerson, Edwards, Elliott, Findlay, Holmes of Maine, Johnson of Ky. Johnson of Lou. King of Alabama, King of N. York, Lowrie, Morril, Noble, Southard, Stokes, Walker, Ware, Williams of Tenn.--19.

The remaining section was then ordered to be engrossed and read a third time, by yeas and nays--27 to 13.

The Senate then went into the Consideration of Executive business, and so continued until past 3 o'clock: when
