The case of the State vs. Jacob Sanders, colored, charged with assault with intent to kill Charles E. Tomlinson, colored on April 1, at Lafayette and Washington street, occupied the Court of General Sessions yesterday afternoon.
Deputy Attorney-General Giles represented the state; Peter L. Cooper, Jr., represented the prisoner.
The crime grew out of jealousy.
The witnesses called by the state were Charles Tomlinson, James Jones, James Tull, Dr. Henry Stevens and Police Sergeant Wigglesworth.
The effort was to show that there was no provocation.
Mr. Cooper called Violet Gibbs, Clara Lewis, Ervin Elbert, Albert Cooper, who swore that Tomlinson started the fight by striking Sanders with a black jack.
The state called Detectives McVey and James Jones who swore that Violet Gibbs's character was bad.
The case was submitted to the jury without argument and returned a verdict of guilty of assault.
Court adjourned before sentence was pronounced.
