Pawnbroker Stern Says He Can't Be Positive-Sees Too Many People in His Business.
(By Associated Press.)
NEW YORK, April 12.-J. Morgan Smith and his wife who were brought here from Cincinnati yesterday, to answer to the charge of conspiracy with Nan Patterson to obtain money from Caesar Young, will not plead to the indictment until next Friday. They were arraigned in the court of general session today, but, upon request of their attorney, the case was continued.
Bail was fixed at $3,000 each, which, up to a late hour tonight, had not been furnished.
Among the witnesses in court to identify Smith was Hyman Stern, the pawnbroker who sold the revolver with which Caesar Young was killed. Before going into court Stern said he was doubtful if he could positively identify Smith. He said he saw so many people in his business it was impossible to remember them all. After he had seen Smith, Stern today said: "What I said before about not being positive goes."
