PHOENIX, April 25-Exactly thirty-seven days following the day the legislature convened, the recall amendment to the constitution applicable to state officers has been passed by both houses. It will now take several days for the bill to reach the governor and probably not until this article is being read will the executive have acted upon the measure probably giving the same his approval. It is hardly in keeping with the two frequent assertions made by the members of the majority during the last campaign, that before twenty-four hours had passed after the legislature had convened providing democrats were selected members the recall would be passed, submitting to a vote of the people that part of the constitution taken out by vote to meet the requirements of approval and the securing of statehood.
And in its present form the legislature has failed to definitely assert what it means by the use of the word approval, whether the recall measure as submitted is approved as to advisability or just as to form, as the lawyers say. The house members of the conference committee which last dealt with the recall claim that it is just approved as to form, while the senate members claim it is just what the people should have and they have passed the same after consideration and actually approve the scheme.
It was a neat way the conference committee had of side stepping the whole proposition. The senate amended the house bill by adding an approval clause which read, "The said proposed amendment as set forth in section one of this act (the original recall provision of the constitution) is hereby approved." The house disagreed to this and asked for a conference and to the above after days of wrangling, the conference committee added, "in accordance with the provisions of Section 1, article 21 of the constitution of Arizona." And as was said it might have added still further the words, "whatever that means."
But any way the recall is out of the way and will soon be in the office of Mr. Osborne, secretary of state, and he will prepare the necessary orders to have the proposed amendment to the constitution submitted at the next general election.
