IMPEACHED GOVERNOR REFUSES
TO VACATE OFFICE.

Indications Point to Clash When Mr.
Sulzer and the Lieutenant Gov-
ernor Meet.

Albany, N. Y., August 13.-With
Governor Sulzer impeached by the as-
sembly and the date of his trial before
the senate and the judges of the court
of appeals set for September 18, the
spectacle was presented tonight of
two men claiming to be governor of
the State of New York.

As soon as the articles of impeach-
ment, adopted early today by
the
democratie majority in the assembly,
were presented to the senate, shortly
after 3 o'clock this afternoon, Lieu-
tenants Governor Martin H. Glynn an-
nounced his intention of occupying
the executive chamber.

Friends of Governor Sulzer declar-
ed that the governor intended to con-
tinue in office and would use every
weapon in his power to maintain his
power on the ground that the assem-
bly had no constitutional right to
consider impeachment at its extra-
ordinary session.

Some asserted that the governor
would go so far as to summon mili-
tary protection if necessary to pre-
vent the lieutenant governor from oc-
cupying the executive chamber.

Judge D. Cady Herrick, who will act
as chief counsel for the governor at
his trial, said tonight that "talk of
resort to force is the merest rot."

Seal Locked From Sulzer

Albany, N. Y., August 14.-The great
seal of the State of New York was
locked and chained this afternoon to
prevent its unwarranted use. The seal
is in the office of Secretary of State
May. Mr. Glynn's confidants assert
that Mr. May will permit the lieuten-
ant governor, but not Governor Sul-
zer, to use it. The key is in possession
of a deputy to Mr. May.

The question of who is chief exe-
cutive of the State of New York--Wil-
liam Sulzer or Martin H. Glynn-still
was unsettled when the lights went
out in the capitol tonight. Both the
impeached governor and the lieuten-
ant governor claimed to be directing
the machinery of government,
and
both spent a busy day in their re-
spective offices with counsel
and
friends formulating plans to maintain
their authority.

Meanwhile, the governor's wife, who
is expected to be the star witness at
his trial, lies in a critical condition
in the executive mansion. Her ner-
vous collapse yesterday, which was
accompanied by hysteria, grew
so
serious this morning that the gover-
nor sent to New York for two more
specialists. Mrs. Sulzer had a high
temperature and a rapid pulse during
most of the day, but her condition was
reported as somewhat improved to-
night.

The whole machinery of State gov-
ernment was demoralized today as a
result of the unique contest between
the rival claimants for the executive
office, and already the double exer-
cise of authority has precipitate com-
plications with two other States--New
Jersey and West Virginia.

Sulzer Signs Papers.

The impeached governor signed re-
quisition papers today for the gov-
ors of each of the States for the
extradition for prisoners in the State
of New York.

Whether the officers in charge of
the prisoner-the police commission-
ers of New York City-would recog-
nize the requisition papers
when
served upon them; whether the gov-
ernors of the two States would also
recognize them; whether in the event
of such recognition counsel for the
prisoners would resort to the courts
with a plea that the extradition of
their clients was illegal-these were
unprecedented questions which the
situation presented tonight.

The prospects tonight were that the
contest between the rival claimants
to the governor's chair might be de-
cided in the courts by the presenta-
tion of an agreed statement of facts
arrived at after consultation between
their respective counsel. Such a
consultation has not yet taken place,
but D. Cady Herrick, chief counsel
for Sulzer, indicated that such pro-
cedure was likely to follow.
