Capone Seeking Review By Court

WASHINGTON, May 26. (U.P.)—Al Capone today asked the supreme court to reconsider its recent decision not to review his case which caused him to be sent to Atlanta penitentiary for income tax fraud.

Formal application for a re-hearing on his petition for a review which was denied May 2 was filed with the clerk of the court by Michael J. Ahern, Capone's lawyer. Ahern said the court had apparently overlooked "the force and effect" of several of the contentions which had been raised in an effort to have Capone's conviction reversed.

The application will probably be acted on Monday, the last day the court will sit this term. While such applications are frequently made to the court they are rarely granted.
