Atty. Gen. Eugene Cook has submitted to Georgia mayors a proposed city ordinance which would require the NAACP and other organizations to publicize their membership, financial records, and give other information.
Meanwhile, an appeal of the Atlanta Branch NAACP of a contempt of court conviction, which from the group's refusal to supply its financial records to state revenue agents, has been halted.
The stoppage came Monday when the Georgia Court of Appeals refused to review its previous decision which said Fulton Superior Court, Judge Durwood T. Pye did not have to approve an NAACP version of the contempt trial record.
TRIAL RECORD NEEDED
The local NAACP needs the trial record to appeal the contempt conviction in which it was fined $25,000 and J. H. Calhoun, branch president, was given a one-year suspended sentence.
The proposal submitted by Atty. Gen. Cook Monday said cities in this state could adopt such an ordinance under their power to levy business and occupational license taxes and to exempt non-profit, charitable or benevolent organizations.
The NAACP is non-profit, tax exempt organization.
The proposed ordinance would allow cities to demand names of officers, employees and agents of the organization, and salaries paid: financial reports of income and disbursements: and affidavits stating whether the organization is subordinate to a parent group.
