'It is not a violation of the law for an Indian to have liquor in his possession when off the Indian reservation, nor does the Indian commit any crime when he buys liquor off the reservation, but the party who sells or gives any Indian liquor, be he either Indian or white person, is guilty of a crime, no matter if the transaction does take place off the reservation.'

This constituted a portion of the instructions Judge Dietrich gave the jury at Moscow, Nov. 8, in the case of John Scott, an Indian, being tried for giving another Indian a bottle of whisky while in the city of Lewiston. Scott was acquitted.
