SAN FRANCISCO, June 25. (AP) Charley Frank, twice convicted of killing Joe Sparrows at Nome in 1928, in an argument over the alleged attentions Sparrows paid Frank's wife, was ordered given a new trial by the United States Circuit Court of Appeals here.
The court ruled that Frank who was twice tried by a jury the members of which were pre-judiced against him should have a new trial and commented that "Homicide was a matter of common gossip in the community."
Frank was sentenced to life on his first conviction and to forty-five years imprisonment on his second trial. He pleaded self defense.
