Editor Republican: Allow me to correct a statement in your paper in relation to the suit for wharfage against Thornton Smith, decided by Justice Clark. Mr. William A. Cook did not appear for the corporation. I instituted the suit without his knowledge and after the hearing informed him about it. At my request he called on Justice Clark, and in the examination of the case he desired additional evidence, to which, as I understood, the justice consented. I found Mr. Cook very unwell, but about the appointed time he appeared, but the justice decided the case. The decision of Justice Clark amounts to nothing, for Mr. Cook promptly took an appeal in order to obtain the opinion of the Court as to the right of parties to use the canal without paying for it.
