Would Rather Be In Fight

SAN FRANCISCO, June 8.--Showing far less confidence than during his fistic engagements Jack Dempsey, heavyweight champion, was placed on trial today charged with evading the draft. He appeared nervous and intently watched prospective jurors.

Twelve temporary jurors had been selected this afternoon.

TESTIMONY OF WIFE NECESSARY TO CONVICT

SAN FRANCISCO, June 8.-Heavyweight Champion Jack Dempsey's trial on a charge of conspiring to defeat the operation of the selective service act was scheduled to start here today before United States District Judge Morris T. Dooling.

Jack Kearns, the pugilist’s manager, is a co-defendant, accused of aiding the fighter to evade the draft.

Assistant United States Attorney C. W. Thomas, who was attached to General Pershing's staff in France as a colonel, is in charge of Dempsey's prosecution. American Legion posts throughout the country are watching the case with deep interest.

The defense will be conducted by Gavin McNab, San Francisco lawyer. McNab also is counsel for Mary Pickford in her fight to prevent the state of Nevada from revoking her decree of divorce from Owen Moore.

Chief interest in the early stages of the Dempsey trial centers on whether the government will be able to prove Mrs. Maxine Dempsey, who is responsible for the charges, really is the legal wife of Dempsey. Recently government operatives working on the case admitted it had been brought to their attention that she married Jack in Utah a few weeks after her divorce from her first husband. This is said to have been kept a secret from the boxer, who was kept in ignorance of the alleged fact even after he had been divorced from her.

Should the government show they were not legally married-Utah laws require a year must elapse after a divorce before a remarriage-then the prosecution will be able to use her as a witness against him. It is said that the government depends largely on her testimony to make its case against Dempsey and Kearns.
