In the Debates of the General Assembly at New-York on the 25th of January last, Robert R. Livingston, Esq; appearing in the Assembly Chamber, and producing an Indenture of his being elected, and returned a Representative for the Manor of Livingston; and the same being read, Mr. Speaker asked, whether two Members should wait upon one of the Commissioners, appointed to qualify the Representatives to serve in this present General Assembly- and see Mr. Livingston qualified. A Motion was then made, Whether the Exclusion of any Officer under the Crown, or other Persons (not qualified by Law) from Seats in this House, by a bare Resolve of the House, will not be a high Invasion of the Fundamental Rights of our Constituents in the Freedom of Elections, an Abridgement of the Authority of the other Branches of the Legislature, subversive of our happy Constitution, and tending to the Erection of a Republic in this Colony:--Debates arose, but finally the Question was put, Whether two Members should wait upon one of the Commissioners appointed to qualify the Representatives to serve in this present General Assembly, and see Mr. Livingston qualified? Which passed in the Negative, 15 to 7.---And then a Resolve passed, That the Exclusion of the Judges of the Supreme Court, from their Seats, by a Resolve of the House, will not be an Invasion of the fundamental Rights of the People in the Freedom of their Elections nor an Abridgment of the Authority of the other Branches of the Legislature; is not subversive of our happy Constitution, nor tending to the Erection of a Republic in this Colony: but an Exertion of that Right which the Constitution has lodged in the Representatives of the People, 15 for the Resolve, 7 against it.
