Spence Horn, arrested last week and lodged in the county jail on complaint of S. M. Hershey, who accused Horn of selling liquor to his son, Van Hershey, was brought before Judge Ellis Tuesday forenoon on a complaint filed in justice court and signed by Officer Ed. Campbell, charging him with selling a pint of liquor to young Hershey a week ago last Saturday.
When Horn was arraigned he pleaded not guilty, and young Hershey was then called to the witness stand. He briefly told of the deal with Horn in which he bought a pint of moonshine on the date in question for which he paid the sum total of $2.50.
Hershey was the only witness to testify for the state. Horn, the defendant, did not offer any evidence.
The court rendered his decision finding for the state. He assessed a fine of $100 and costs, about $106 in all, against the defendant, whose attorney, L. H. Laughlin, filed notice of appeal to the district court. A Mr. Slagle, father-in-law of Horn, appeared as surety on a $300 bond.
Judge Sabin appeared as prosecuting attorney, and Attorney S. D. Killeen was present to look after the interests of Mr. Hershey and his son in the case.
Horn is a resident of Glenover, and is working about town as a carpenter. He formerly was employed on the Union Pacific as a fireman with run out of Beatrice.
