Legislative Summary.
Since our last issue, the Senate has been
principally engaged in the trial of the im-
peachment of Bates the ex-treasurer. His
defense, so far has been a technical one, that
he was not an officer at the time the impeach-
ment was presented against him. On this
point there was some very able argument but
it was over-ruled by a vote of 24 to 9. He
is now required to answer to the merits of the
charges.
The impeachment case of Controller Whit-
man was called up on Monday, when he filed
his answer, denying any criminal intent or
violation of law in his acts. His case was
postponed for two weeks.
The Senate have passed the bill to increase
the pay of the County Judge and District
Attorney of Calaveras county.
The bill granting to a company the right
to build a bridge across the river at Sacra-
mento and collect tolls on it for 30 years
passed the Senate, Mr. Crandall voting, "aye."
Mr. Norman, "no."
A bill for an act to prohibit noisy and
barbarous amusements and to prohibit busi-
ness transactions on Sunday has been favor-
ably reported on by a committee of the
Senate.
The message of the Governor announcing
his veto of the appropriation bill, was com-
municated to the Senate on Saturday but
not acted on till Wednesday, when it was
sustained by a vote of 24 to 7.
A new bill was forthwith introduced by
Mr. McCallum, making appropriations to
defray expenses till the last day of April.
In the Assembly the committee of "Ways
and Means" reported in favor of the "stamp
act" bill, and after a long discussion it was
ordered to be engrossed by a vote of 50 to
18; plainly indicating the passage of the
measure by that body.
The affairs of the State's prison, which are
truly in a bad condition have been eliciting
severe comment from the members of the As-
sembly. A committee has been appointed
to confer with the lessee, Estell, to devise
some means of relief.
The amendment to the law in regard to a
change of venue in criminal cases, has passed
both houses and received the sanction of the
Governor. Heretofore a change was in the
discretion of the court,--now, under a cer-
tain showing, pointed out in the new law, the
court is bound to grant the change. This
alteration was made to meet the case of Ned
McGowan.
