MARYLAND ELECTION

Some of the democratic prints in Baltimore affect to consider the late return of the judges of election in Alleghany as highly improper: As a correct statement of the grounds of that decision has not yet reached us, and of course it is not likely to have reached them, it seems rather premature to express a decided opinion upon the return, and those gentry would have been more cautious, if their object had been to form a correct decision.

It is stated that in one of the districts one or more of the Judges omitted to qualify. If so, unquestionably the poll of that district could not be received, . without being qualified, he was no more a Judge of the election than any other individual. and if out of curiosity any other person had thought proper to open a poll, and had taken votes in that district, he might with equal propriety have claimed that his poll should be received

The only question therefore is, whether the return of the judges shall be confirmed or a new election ordered? Upon this question a decision by a democratic house of delegates some years since in the case of a return from Charles County, and when a poll was not received from one of the districts, will be of importance. It will be found that the democrats themselves have declared a return valid, altho' it did not include all the districts of the County. It would be well also for these democratic gentry to recollect their own decision in the case of a contested election for electors of the Senate from Prince George's County in 1806. E H Calvert, Esq. Was returned as duly elected and it appeared that he had a majority of the legal voters But because some few votes had been taken in one of the districts one or two minutes after the hour for closing the polls had arrived, according to some Gentleman's watch, it was determined that those votes not being taken in strict conformity to law should be rejected, and Mr. Calvert was deprived of his seat, though elected by a majority of the votes of the County. How often are mistakes committed by voters in making out their tickets, and in consequence their ballots rejected ?. In some instances a sufficient number of these ballots, to give a different result to the election has been rejected, and yet nobody ever thought, that on this account the return of the Judges ought to be set aside.

It is said that in some of the districts of Alleghany a great number of illegal votes were taken. Foreigners, who had not been naturalized, and soldiers who happened to be there were permitted to vote for the war-men, and that if these were rejected, the federal candidates had the majority, altho' the poll of Hoitzman's district was received. If this report be true, then the house of delegates, will have to decide first, whether the poll of that district ought to have been received ? If the house concur in opinion with the judges, then there is an end of the subject, and the Gentlemen who have been returned, retain their seats. If the house reverse the decision of the Judges of election, it will then be for them to enquire, what illegal votes were given to the democratic candidates, and whether after deducting those votes, they have a majority.

If this investigation should be necessary, a considerable time must elapse before a decision can be had, and it would be a serious inconvenience to the county . to remain un-represented until then. For let it be remembered that large appropriations will be necessary in order to defray the probable expenses of the war the next year, and it would seem but just that when the treasury of the state is to be beggared, Alleghany should have a vote.

But the democratic papers would really alarm us. They are at once for dissolving the Government, and call upon the Senate not to join in the election of Governor if the delegates from Alleghany take their seats And does all this come from the exclusive lovers of our republican systems of government ?- Do they openly avow a wish to destroy the constitution ? Let it be remembered that the people of Maryland have declared in favor of the peace party A majority of 12 would be found in the popular branch of the legislature, altho' three democrats from Alleghany were permitted to take their seats. But the Senate would overbalance this majority and how does this happen? It is owing entirely to a contemptuous disregard by the Senate of the wishes of the people.-Again, and again have the people of Maryland, by their representatives demanded that the Senate should be chosen by the people, and if this request had been gratified by the Senate, the federalists would have at this time an overwhelming majority in the two branches of the legislature. Surely those who hold their appointments " in contempt of the people" will not talk about the voice of the people.

But the Senate is to dissolve the government !!! Now without allowing to that body more wisdom or patriotism than it really has, it may be taken for granted that this self same Senate will be in no humor to gratify any such request, and for this obvious reason If the Senate should thus act, the people would of necessity form a new government, and, as the Senate well knows would not choose to provide for their continuance in office, but would say that that branch of the legislature as well as the other should be elected by the people. Now as this Senate would rather hold their seats a few years longer, they will not take a step, which would defeat their wishes. Who among us believes, that our Senate would violate the Constitution and their oaths merely to lose their seats?

Election.-It is now ascertained that the four federalists are returned as elected in Alleghany From the election law, and from various cases decided by the House of Delegates on disputed elections, which precedents will be produced hereafter. there is no doubt that the return from Alleghany is right, and that the federalists are duly entitled to take and to hold their seats. There is little doubt we imagine that they will do so, as they are in duty bound to do.

Furthermore, from what we hear of the democratic Annapolis election, it would seem clear that it must be set aside. The Constitution as it regards Annapolis was not changed by the new district system, and the poll in that city ought therefore to have been kept open for four days, if required, or unless closed by consent. We understand that the Federal Candidate Mr Bowie, not only did not consent, but objected pointedly against the poll being closed the first day, but it was done, and several of his friends were thus prevented from voting. If so, the two democrats from Annapolis will have to walk out.
