I noticed, in your paper of Friday last, a number of questions relative to the proceedings in the case the State vs. Mackay, &c.— The apparent object of these questions is to censure the Judges for the part they took in the case.
The writer is guilty of gross ignorance, or wilful misrepresentation. Perhaps he may justly claim "credit for both."
My object in this communication is merely to state, that the first Count in the Indictment alluded to, was discontinued by my authority ; and that I alone am responsible to the publick. The Court approved of, but did not direct, the measure. If Sidney is dissatisfied with the proceeding, and will come forward with his real name, I will endeavour to answer any intelligible question, which, with the assistance of his friends, he may be enabled to ask.
