A Federal District Court grand jury in Chicago has returned indictments against United Enterprises, Inc., and two of its officers, alleging falsifications of records and 31 counts of OPS ceiling price violations.

It is one of the first grand jury actions against alleged OPS price violators.

U. S. Attorney Otto Kerner, Jr., who presented the case to the grand jury in the court of Federal Judge John P. Barnes, explained that the indictments are based on charges that the defendant company violated the General Ceiling Price regulation by selling at over-ceiling prices, and that a price circular dated January 15, 1951, increasing many of the company's prices actually was printed after the General Ceiling Price Regulation became effective on January 26, 1951. Under this regulation, the firm could charge no more than the highest price for which goods were offered between January 15, 1950 to January 25, 1951.

According to Nathan J. Kinnally OPS enforcement director for the Chicago district, the firm had a price list printed after January 25, predating it as of January 15. The firm was given the opportunity of revising its ceilings, advising its customers of the change and refunding any overcharges, but declined to do so, Kinnally said.

According to OPS officials, the firm which manufactures stainless steel tableware, is charged with ceiling price violations approximating $5,000. Possible maximum penalties on conviction are a fine of $10,000 or one year's imprisonment on each count of price violation, and not less than 5 years in the penitentiary or $10,000 fine or both on the falsification indictment.
