Tom Mix Is No Mollycoddle In Handling Fists

LOS ANGELES, Sept. 3, (AP)-- With the acquittal written by the Los Angeles court the final scene in a house warming party which came to an end one Sunday morning on the beach was enacted here Saturday with the freeing of Tom Mix. Western movie star who was tried in the municipal court on charges of assault and battery preferred by Will Morrissey, cabaret and stage comedian.

The case was heard by Judge Wilson who decided that both Morrissey and his wife were drunk and got into a scrap which involved a stream of profanity from the comedian. Mix was provoked and the court held that he had acted "as only a prudent, red blooded" man would act under the circumstances and had a right to defend himself from a verbal and fistic attack.
