There were several new applications for roads, and several important Cases relative thereto, transferred from Rockingham and Hillsborough, to this County. Among the latter, and one that excited great interest, was the petition of James Stark, and others, for a road from Dunbarton line, through Hopkinton, Boscawen, Salisbury and Andover, to the 4th N. H. Turnpike.
On that petition, a committee had been appointed and reported in favor of laying out the road—and the Towns of Boscawen, Salisbury and Andover, resisted the acceptance of that report.
The case was ably investigated, and occupied two entire days.
The expense of making the road through these towns, was estimated by a number of witnesses, to amount (including damages awarded to individuals) to upwards of 12,000 dollars.
The case was handsomely opened by Messrs. Horace Chase and Gove, and closed with much ability and ingenuity by Mr. Rogers.
The Hon. Mr. Webster, was counsel for the opposing towns, and his speech which occupied about three hours, was for sound argument, wit and humor, one of the ablest specimens of forensic eloquence, that we have ever witnessed.
A large and respectable audience attended, mostly from the towns interested in the question.
The Court accepted that part of the report only which laid out a road through Hopkinton; and we understand, was not opposed by the Counsel in the defence.
