NEWARK, May 31, 1905.-Italians who have interested themselves in the effort to save from the gallows Joseph Marmo, convicted of murder in the first degree and under sentence to be hanged on Thursday morning, are all at sea as to what will be done in the less than forty-eight hours that remain before the time set for the execution.
Chauncey H. Beasley, who it was understood last week was to appear before United States Judge Lanning or Cross in Marmo's interest, could not be seen today. It was said yesterday by John Casale that Mr. Beasley would not be concerned in the case and that it would be taken up by James H. Trimble and Nathan Kussy. Mr. Casale is the chairman of the committee which has furnished the funds for several legal actions taken.
Mr. Trimble said today that while the case had been taken to Mr. Kussy and to him, neither of them would have anything to do with it. It was considered by Mr. Kussy in Mr. Trimble's absence, but the latter is in poor health, and upon his return yesterday decided that he would not take it up. Mr. Kussy has gone away on a three days' business trip. Thomas S. Henry said today that he had been asked to take the matter up, but had replied that he could not consider it. He had looked over all the evidence and had become convinced that while the execution of Marmo could certainly be postponed, if the proper legal procedure were taken at once, it would only be a postponement and the man would have to die sooner or later.
However, in spite of the situation involved as it is, men who are conversant with the matter express the opinion that an application for a writ of habeas corpus will be made tomorrow before Judge Lanning or Judge Cross at Trenton, presumably by Mr. Beasley. Such an application, whether granted or refused, would carry a stay of execution.
