BARLOW FILES ANSWER.

Chief of Police Denies That Applegate
Pool Room Is Lawful Occupation,

Chief of Police Barlow, through City
Atty. Dininny, yesterday filed his answer
in the district court replying to
the application of Applegate & Co.,
for an injunction restraining the police
from interfering with the business of
the company in selling pools on horse
races.

When the chief of police attempted
to close the poolroom a few days ago
his officers were confronted with a restraining
order issued out of Judge
C. W. Morse's division of the district
court. The hearing of the application
for the injunction was continued until
Monday next, but yesterday City Atty.
Dininny filed the city's answer to the
petition.

In answer to the petition of the
plaintiff company it is denied that the
plaintiff is engaged in lawful business
and it is charged that the plaintiff
violates the ordinances of the City of
Salt Lake, specifically section 443, which
reads:

"It shall be unlawful for any person
to keep a house, shop or any other resort
for the purpose of gambling, or to
permit or suffer any person in any
house, shop or other place under his
control or care, to play at cards, dice,
faro, roulette, keno, or any other game
for money or other property, or thing
representing money or other property.
In a prosecution under this section,
any person who has charge of, or attends
to any such house, shop, or place,
shall be deemed the keeper thereof."

The answer also alleges that many
people visit the "poolrooms" of the
plaintiff and there wager money, and
a description of the manner of conducting
the wagering on horse races is
given.
