DRANK THE EVIDENCE.

Jury in a Whisky Case Sent Out for the Exhibit.

Salt Lake City, May 27.-In its zeal to absorb all the facts in the case, a jury in the district court has not only nullified its own verdict of guilty, but made it impossible for the prosecution to make out a case before another jury.

J. M. Doull, a druggist, was on trial for selling liquor without a license. While deliberating the jury sent for the exhibit, a flask of whisky. When it was returned to the court room, Judge Lewis noticed that it was empty. He reprimanded and dismissed the jury and notified the defense that a motion for a new trial would be granted. The motion was made and the state will have to dismiss the case for lack of its chief evidence.
