YOUTH WHO ALSO WAS ACCUSED OF STEALING HORSE TAKEN BEFORE JUDGE RECK AND CONFESSES-SEARCH REVEALS HIDDEN STILL.
Clyde Stewart, aged 21 years, who after an unsuccessful attempt to hire a horse to go to the country and get some moonshine "borrowed" one without the permission of the owner, pleaded guilty to the misdemeanor in the county court yesterday afternoon. After hearing the plea Judge Reck sentenced him to thirty days in the county jail.
Stewart's sentence will date from the time of his hearing. He has already been a prisoner in the county jail for five weeks.
On Dec. 17 Stewart went into the McCormick livery stable and attempted to rent a horse, informing Mr. McCormick that he wanted to go out in the country to get some moonshine. McCormick refused to rent one of his horses for such a purpose. Some time later he found a horse and buggy missing from his barn.
He reported the matter to Sheriff Ayers, who located the horse where it had been left by Stewart after his trip to the country. In the search the officer unearthed a still in the woods south of town. George Kline of Marseilles, the owner of the hootchery, was prosecuted and fined $300 and costs, after he pleaded guilty to violating the search and seizure laws.
