Employe of Private Department in Store Can't Collect, Rule

Under a ruling by the state industrial commission late yesterday, an employe of a privately owned department in a department store, is not an employe of the store and cannot be compelled to recover damages under the workmen's compensation act when injured in the store while not at work.

Grace Lundgren, the plaintiff, was injured when she slipped on some mayonnaise dressing which had been spilled on the floor. She was an employe of a privately owned department of the department store in which the accident happened and was shopping during her lunch hour in another section of the store.

The case will now go to trial in circuit court.
