Threat of Governor Abelardo Rodriguez of the northern district of Lower California, to close the international border to trains after 6 p. m. at Tijuana and 9 p. m. at Mexicali, will not prevail and is a thing of the past, following a decision of the Mexican federal court at Tijuana yesterday.
Following the refusal of the United States to change the present hours of closing the line to pedestrian traffic, the governor issued an order declaring that trains would not be permitted to cross the line during the hours when passage was refused to pedestrians. The move was believed to be in retaliation for the action of the United States, though this was denied at the governor's palace.
The Inter-California Railway and the Tijuana and Tecate Railroad, subsidiaries of the San Diego and Arizona and the Southern Pacific, which operate in Mexico, filed suit in the Mexican courts asking an injunction against the governor's order.
In the meantime, the effective date of the order was deferred from July 1 to September 1, following a meeting of Imperial Valley business men at Calexico, protesting against the order.
The court rendered its decision yesterday, granting a permanent injunction against the governor's order, which is generally believed to mark the close of the matter.
The governor has the right of appeal to a higher court, but in well informed circles it is not believed he will take such action.
Although such action does not appear on the surface, it was pointed out some time ago that the governor would have a difficult time maintaining his position. Mexican leaders in the Mexican capital realize the debt their country owes to the United States for assistance in quelling the recent revolution and are loathe to take any action that will interfere with the friendship existing between the two countries.
