ONE OCCUPANT OF MURDER CAR SURRENDERED

Harry Vallon Made His Appearance at Headquarters and Was Locked Up.

BELIEVED OTHER MEMBERS OF ASSASSIN PARTY WILL FOLLOW

Vallon will be Sweated in an Effort to Get Him to Divulge the Names of the Others Concurred in Rosenthal Murder.

New York, July 23.—The gunmen wanted for the killing of the gambler, Herman Rosenthal, are beginning to fall into the net. Harry Vallon, one of the five notorious gangsters who were in the murder car the night Rosenthal was shot, surrendered himself to the police this morning and within ten days Deputy Police Commissioner Dougherty expects to round up the whole gang.

With the men who actually did the shooting in the toils, the main work of District Attorney Whitman and Deputy Commissioner Dougherty will commence that of trying to learn the identity of the conspirators who so greatly desired that Rosenthal be done away with before he could make further revelations of the relations between the police and the gamblers.

Several of New York's prominent citizens have offered to pay for a private investigation into the question of whether the police were in partnership with the gamblers which led to the slaying of Rosenthal.

Commissioner Dougherty remarked insignificantly to District Attorney Whitman that "I guess we agree as to who is back of this killing."

But the police prosecutor does not feel that Dougherty can swing the investigation of the killing alone, as he is of the belief the police department will give no real aid.

The surrender of Vallon may be followed by the voluntary appearance of other gangsters known to have been in the murder car the night of the killing. Besides Vallon there were Harry Horwitz, best known under the gang name of "Gyp the Blood," Dago Frank, an east side gangster, "Baldy" Louie and "Whitey Lewis."

Vallon has nothing of the appearance of a gangster of the meaner sort. His appearances at headquarters dumbfounded the desk sergeant and he had to convince the detectives as to his identity before they would lock him up.

Vallon drew up a taxicab and the loungers saw a fastidiously dressed dapper little chap step lightly out from the car, and, swinging a cane from a gloved hand, mount the steps of the building.

"Kindly tell me where the detective bureau is," he asked and soon he was behind the bars. Dougherty planned to give him the "third degree" late today.

"Bald Jack" Rose, Sam Paul, "Bridgie" Webber, William Shapiro and Louie Libby, all held by the police for complicity in the murder, were arraigned before Coroner Felsburg yesterday. The results of the hearing in which the district attorney won the first scrimmage with the attorneys for the accused, are briefly as follows:

Rose, gambler and friend of Lieut. Becker, whom Rosenthal charged with being his partner, was held without bail for the coroner's inquest Thursday.

Rose is said to have hired the murder car in which the gun men later went to assassinate Rosenthal.

Louis Libby, part owner of the automobile was held for the presentation of further evidence Thursday and the case of William Shapiro, chauffeur of the car, was likewise put over to that date.

Bridgie Webber, in whose place in Forty-second street the gun gang is said to have congregated and Sam Paul, were held without bail until Wednesday.

Jack Sullivan, alleged go-between for Rose and Lieut. Becker, was held as a material witness in $100 bail, which was furnished.

Another equally important development of the day was the entrance of Mayor Gaynor into the case. By orders of the mayor the independent investigations which have been conducted by the police and district attorney's office have been concentrated under District Attorney Whitman.

Mayor Gaynor summoned Police Commissioner Waldo and instructed him and Deputy Commissioner Dougherty to act in harmony with the district attorney, no matter what friction might have crept between them. The result was that Dougherty went at once to see Mr. Whitman.

New York, July 23.—Jack Rose, known to his friends as "Bald Jack," is held in the Tombs charged with being in a conspiracy that resulted in the assassination of Herman Rosenthal, the gambler, in front of the Hotel Metropole. He has admitted that he hired the auto in which the slayers rode to the scene of the killing, but declares that he left the vehicle some time before the shooting. Police Lieutenant Charles Becker, who had been named by Rosenthal as his partner, denies ever having any business relations with the gambler, though they were acquainted and had dined together. Policeman File, who was in the dining room of the Hotel Metropole at the time of the shooting, has been suspended without pay by Commissioner Waldo. File was off duty at the time, but he is accused of being derelict in not arresting the murderers or in following them with more alacrity than he showed.
