The state board of health has been
again overruled in the appellate court.
Today the court handed down a rescript
in the case of Dr. Arthur W. Stevenson,
deciding that the board must recognize
the medical school of Boston University.
The rescript handed down in this case
is as follows:
"The respondent attempts
to justify its refusal to issue a license
to the appellant to practice medicine
because it does not recognize the medical
school of Boston University as a school
requiring the four-years' course of study
for graduation. It appears from the evidence
that the course of study in this school is
four years, and that the appellant has
taken the full four years' course. It
further appears, however, that students
of medicine who have taken in literary
and scientific schools, courses of study
relating to or forming a part of the study
of medicine, such as chemistry, biology,
bacteriology and botany, on passing the
required examinations may be admitted
to advanced standing so that it is possible
for such students to obtain a degree in
less than four years' study in the school
itself. It is this possibility which has led
to the refusal of the respondent to recognize
the school as a four-year school, though
no objection exists against it in any other
respect. We do not understand from the
evidence that the practice of the Medical
school of Boston University in admitting
students to advanced standing on passing
the required examination is different from
that of other four-year schools, and we
see, therefore, no sufficient reason why
the respondent should withhold its approval
from that school as not a four-year school.
Our opinion is, therefore, that the appellant
is entitled to a license."
