Judge Fitzgerald Rules No Jury Trials For City Court Appeals

ANCHORAGE-Superior Court Judge James Fitzgerald has ruled that persons appealing convictions under city ordinances to the higher state court are not entitled to jury trials. His decision opens the way for an appeal to the Alaska Supreme Court.

Three attorneys had argued before the superior court that their clients, appealing city misdemeanor convictions, were entitled to trial by jury. A city attorney countered that they were not.
