STILL IN DOUBT
MATTER OF PROCLAMATION LOOKED TO WITH GREAT INTEREST.
Atlanta, Nov 29. Governor Hardwick announced he would take no action in the Peach county case until next Monday on his return from a visit to Southwest Georgia.
Atlanta, Nov. 28. What conclusion Governor Hardwick will reach in the matter of a proclamation on the proposed constitutional amendment creating Peach county, in which a protest was filed yesterday with the Secretary of State, remained in doubt today, in the absence of the Governor from his office.
It is known though, that the questions raised by the protestants are recognized as of very considerable weight, and that the Attorney General has rendered an opinion on the subject, that opinion being now on the Governor's desk. His finding in the premises, Mr. Napier does not feel at liberty to indicate until the Governor himself has read the opinion.
It appears to be conclusive the matter will be finally determined so far as the executive department is concerned, tomorrow, and at that time a proclamation will issue declaring one way or the other on all the proposed constitutional amendments.
In the Peach County matter the opinion has been ventured that the final settlement of that question will find its way into the court since, on the certification filed with the Governor by the Secretary of State yesterday, there is no conclusive information on which the Governor can act in drawing his proclamation. On the face of the returns as sent to the Secretary of State the tabulation shows one result, which defeats the proposed new county amendment.
The protestants have filed complaint that the law on elections and election returns have not been complied with in several respects, and the Secretary of State has certified that the citations made by the protestants are found by him to be true and correct in respect of failure to comply with the law. The certification therefore shows that if the full tabulation is taken as the guide the result will be one way, whereas if the illegally handled counties are excluded from the tabulation and total, the result will be the other way--that the amendment will have carried.
