New Trial For Six

TRENTON, N. J. March 21. (ANP)--Only six persons, three men and three women, have been selected for the jury in the new trial of the Trenton Six.

The Trenton Six are six Negroes accused of killing William Horner, 72, junkman and shopkeeper, three years ago during a robbery. The accused are: Collis English, Ralph Cooper, James Thorpe, McKinley Forrest, James McKenzie, and Horace Wilson.

During the third day of selecting grand jurors only one person was chosen. He was Horace N. Steveson Sr., Trenton salesman and father of four children and grandfather of seven. Two men and three women already had been picked for the jury.

Challenges are being used by both sides, particularly on questions of the death penalty and the feeling of the guilt or innocence of the defendants.

The trial will be held in the Superior court with Judge Ralph J. Smalley officiating. A total of 12 jurors and two alternates are to be selected.

Originally brought to trial in 1948, the Trenton Six were found guilty of the murder of Horner, mainly through testimony of his common law wife, Elizabeth.

The New Jersey State Supreme court, however, ordered a retrial on the basis of an error by the trial judge in refusing to let the defense question police about fingerprints and how they obtained "confessions" from the defendants.

Mario H. Volpe, county prosecutor, and Frank Lawton, assistant district attorney, will represent the state.

Representing the defense will be Raymond Pace Alexander of Philadelphia, Arthur Garfield Hays of New York, George Pelletiere, Clifford R. Moore, and former Judge Frank S. Katzenbach of Trenton and J. Mercer Burrell of Newark.

The trial is expected to last from six to eight weeks.
