Active work on the Calendar Begun--List of Causes Continued, Passed, Submitted on Briefs and Dismissed.
The territorial supreme court has settled down to business and for the next two weeks it is presumed that a large portion of each day will be devoted to clearing up the calendar. That there is nothing very easy connected with the experience a judge will conclude who visits the court room and after sitting for a few moments, will realize that their honors are engaged most of the time in laborious listening to weighty arguments.
The cases on the calendar have been taken up in their order and either passed, continued or a time set for hearing. The passed and continued cases are: The United States vs. E. D. Carpenter, continued; A. B. Dougherty vs. J. M. Dickson, continued; Territory of Dakota vs. J. W. Raymond, treasurer, continued; George Hollenbeck vs. C. H. Prior and others, continued; the National German American bank of St. Paul vs. P. V. M. Raymond and E. A. Raymond, passed; the Franz Falk company vs. A. W. Mielenz and others, passed; G. A. Cody vs. the O. M. & St. P. railway, passed.
The cases submitted on briefs are the territory vs. Wm. Crozier and Peter Samus vs. Lewis Spawn.
Order for dismissal was made in the case of O. R. Keith et al vs. O. H. Winsor et al.
A motion to dismiss on stipulation was made in the cases of B. Casey vs. Wm. H. Boothroyd and others. This motion was granted and the case dismissed. Motion to dismiss was made in the case of H. C. Henry vs. F. B. Dean. No decision.
In all other cases time has been set for hearing.
The case of Chas. W. Buttz respondent, vs. J. L. Colton, appellant, from Case county, has occupied the attention of the court to-day. Preceding the argument on the merits of the case, a motion to strike out the bill of exceptions was argued, taking the time well into the afternoon. The case is an important one, having for its basis specific performance of contract.
The argument in the case of the Capital National bank of St. Paul, respondent, vs. school district number 85, Cass and Barnes counties, has been set for to-morrow morning. In this case Governor Davis, of St. Paul, will speak in behalf of the respondent.
