JUDGE CLANCY ISSUES ORDER

Justice of the Peace Case Must Be Certified to Higher Court.

Judge Clancy has issued an order for Justice of the Peace Tim Harrington to certify to the court for review the transcript of the proceedings in the case of Pat O'Flynn against Joe Lang and Maurice Reagan.

The petition for the writ of certiorari sets forth that Justice of the Peace Nelson, Judge Harrington's predecessor, granted judgment by default in the case for $70.90 October 17, 1901.

It is alleged the service was defective in that F. E. Pelling, who served the summons, was not a constable or deputy sheriff, and that Thomas Cosgrove was the regularly qualified constable.
