The case of Norris Murphy vs. Stanley Fullerton was tried to a jury in county court last Thursday afternoon. The petition in this case alleges that on or about January 18, 1933, the plaintiff was driving east on the highway about four miles east of Atkinson, at the rate of about 30 miles per hour and that he had his car under control at all times. When he was about four miles east of the city he said that the defendant came onto the highway from the north. That the front window of the defendants car was boarded up in such a manner as to obstruct his vision and that he drove and propelled his car against the side of the plaintiffs car, badly damaging same. He alleged that the entire left side of the car was badly broken; that the left front and rear fender were broken; that the left running board was broken; that the front door was broken, including the glass in the left front door; that the lights were broken; the front axle twisted and broken; that the steering rod was broken and the bumper twisted. He alleged that damage done to his car was worth $77.15 and he asked damages to that amount. Several witnesses were examined and at the conclusion of the evidence the jury returned a verdict for the defendant and assessed his damages at the sum of one cent and costs of suit.
