San Francisco, Aug. 5.-It has been discovered that the order of the supreme court granting Albert Hoff a new trial was not based on an error on the part of the presiding judge in delivering his charge to the jury regarding the motive but on the question of circumstantial evidence. The supreme court holds that the charge relative to circumstantial evidence in the case was faulty. This places a new light on the matter and precludes the possibility of Mrs. Cordelia Botkin getting a new trial for the murder of Mrs. John P. Dunning, by means of poisoned candy sent through the mails.
