[Correspondence of the American Republican.]

Washington, April 14, 1846.

Fugitive from Justice and Murderer Arrested

I have just learned from Mr. Ball, our jailor, that a man, named Thorn Berry Warder, was brought to the prison of this county at two o'clock, this morning, under a commitment from Justice Goddard. The prisoner is charged with the heinous crime of murder, alleged to have been committed by him in Fauquier co. in the latter part of 1845, on the person of George Smallwood. The credit of this important arrest is due to Capt. Goddard and officers Howison and Fowler, of the Auxiliary Guard, acting under the Captain's directions.

The following are the circumstances which led to the prisoner's arrest. Last evening, about 5 o'clock, information was communicated to Captain Goddard, that Thorn Berry Warder was in this city, and that he was a fugitive from justice from the State of Virginia. Arrangements were then immediately made for the prisoner's arrest, which was effected this morning, about half-past one o'clock, just as Warder was about to step into the stage going to Virginia. He was immediately conveyed to the Watch house, by officers Howison and Fowler, and delivered up to Justice Goddard, who was waiting there for the prisoner. After the usual caution was given to the prisoner by the justice, not to make any admissions that might criminate himself, Richard T. Smallwood, the brother to the murdered man, was sworn, who testified to the identity of Warder, who, although he at first seemed disposed to act upon the Magistrate's advice, eventually admitted himself to be the person charged with the murder of Smallwood. He was then fully committed to await the requisition of the Executive of Virginia.
