Of the Berceau Conclusive.
During the warfare carried on by the late administration against France, one of the American frigates captured the French vessel the Berceau, and carried her into a United States port, where she was condemned as good prize, and ordered to be sold.
In the engagement which took place previous to capture, she was very much damaged. The federal Secretary of the navy, Mr. Stoddert, conceiving the Berceau could be purchased to advantage, empowered a person to purchase her in for the service of the United States, and she accordingly did become the property of the United States.
On her thus becoming a vessel of the United States, the federal Secretary, Mr. Stoddert ordered her to be repaired for service, and the expenses were paid by him out of the navy fund.
On the present executive and ministers coming into office, they found the Berceau repaired and the expenses paid.
According to a stipulation in the convention concluded between the United States and France since that period, the vessels which had been captured from France were to be restored by the United States in as good condition as when attacked.
According to this stipulation the President was bound to deliver up the Berceau and she was delivered.
