FOR DAMAGES
George W. Hamilton, well known Las Vegas man, filed suit in the District Court Saturday against the Los Angeles and Salt Lake Railroad Company for damages mounting to $50,000.00.
The complaint, which was filed by the plaintiff's attorney, Chas. Lee Horsey, states that the plaintiff has been in the employ of various railroad companies during the past twenty years, and that he resigned his position with the Los Angeles and Salt Lake Railroad Company at Los Angeles June 3, 1926.
In March 1928, the complaint continues, plaintiff made an affidavit in connection with the matter of the claim for reinstatement of Conductor J. I. White, with payment for time lost.
In replying to this affidavit, it is claimed, the defendant's agent published the following statement:
"As to the affidavit signed by George W. Hamilton, it might be briefly stated that this man is an ex-employe of this Company, at one time acting in the capacity of trainmaster, having been removed from the service for intoxication."
Plaintiff claims that this statement has tended to impeach his reputation and expose him to the "public hatred, contempt and ridicule."
He asks damages of $25,000.00 for damage to his reputation and ability to gain a livelihood, and $25,000.00 punitive or exemplary damages.
