Laborer Wants Damages for Injuries Received by Caving Earth.

J. Sure, a laborer, began suit yesterday in the superior court to recover $6,100 damages from P. Welch, a railroad contractor, for injuries received in the latter's employ. According to the allegations of the complaint Sure was on August 1 working for the defendant in a cut on the Great Northern right-of-way, and while thus engaged one of the banks of the cut caved in on him. Both of his legs were broken and he was otherwise injured.

It is claimed that the accident was the result of carelessness in making the cut. The plaintiff alleges that he will not be able to work for a year, for which he asks $5,000. For mental pain and bodily anguish he wants $1,000 and for physician's fees $100.
