The case of the State against Stephen Thetston, charged with the murder of George Brandon, was submitted to the jury last Friday evening, who, after being out all night, returned a verdict of murder in the second degree, and fixing the penalty at nineteen years confinement in the penitentiary. A motion was made by his attorneys, Messrs. J. O. Blackwood and C. Adams, for a suspension of judgment, on the ground that the indictment was informal, and in consequence, a want of jurisdiction of the court. The motion, however, was overruled, and the action of the jury sustained.
