Judge Wales' Injury.

HIS PHYSICIANS THINK THERE IS NO DOUBT HE WAS ASSAULTED.

Judge Wales, who was severely injured on Delaware Avenue, near Jefferson street, on Thursday night, is in an improved condition this morning, and no fears as to his speedy recovery are entertained.

Notwithstanding the theory advanced by Mr. James Sanders as to the cause of the accident, Judge Wales still insists that he was assaulted. He says as he was coming past the cemetery he met a slouchily-dressed, ill-favored man, who was not disposed to give way in passing, and against whom he slightly brushed. As he proceeded along the Avenue he heard shuffling steps behind him, and looked around, but could see no one on account of the dense shade of the trees in this locality, though he noticed that the footsteps ceased. Proceeding he noticed the horse grazing close to the fence, which attracted his attention for an instant, and then it was he felt the blow back of his right ear, which knocked him into the street.

Dr. A. H. Grimshaw, one of the attending physicians, is confident that Judge Wales' injury was not caused by the kick of a horse, or by a fall in the street, but by a blow from a hard instrument wielded by a human hand. The wound is a long, ragged cut, immediately behind the left ear, and in such a location that it is impossible it could have been occasioned by a fall or a kick from the horse. This opinion seems to generally prevail, and as on Thursday night people view the affair as a dastardly outrage and a murderous assault.
